The obligation to wear reflective vests was passed

MEPs adopted a draft law that would impose new obligations on pedestrians. It is about ordering to wear safety vests after dark. Pedestrians who do not comply with the order will face a fine of up to PLN 3,000. zł.

 

According to data from the Central Police Headquarters, in 2012 there were 10.3 thousand accidents involving pedestrians. 1167 people died in them. Although the vast majority of such events take place at pedestrian crossings and intersections, a great danger is associated with the movement of pedestrians on roadsides in an undeveloped area. At night, it is virtually impossible to see a pedestrian on time, which is not wearing reflective elements. In 2012, there were 447 accidents, and 59 people died in them. There are many indications that soon there will be fewer such events. SLD deputies prepared a draft regulation that imposed the obligation to wear a reflective vest on pedestrians moving after dark outside the built-up area along roads where there is no sidewalk.

 

Why is it so important? Pedestrian, walking after dark without reflective elements, is visible from a distance of only 20-30 meters. If the driver travels at 90 km / h, he travels 25 meters in a second. It does not give you any chance of any reaction. However, if the pedestrian is equipped with a reflective element, the driver will notice it from a distance of 130-150 meters and will not have any problems avoiding it.

 

SLD deputies wanted the new law to promote safe behavior instead of becoming a whip on pedestrians, which is why they did not foresee penalties for ignoring the requirement to wear reflective vests. Paradoxically, however, it can turn against a pedestrian. As Gazette informs, the police intend to enforce the provisions on general principles, and pursuant to art 79 of the Code of Misdemeanors, a traffic participant who breaks the other provisions of the Highway Code or issued based on it, may be fined up to PLN 3,000. Of course, it is impossible to suspect that this will be a standard punishment for ignoring the requirement to wear a vest, but its amount will be discretionary and it will depend on the decision of the police officer how much we will receive.

 

It is also worth looking at the issue of adjudging blame for road accidents involving pedestrians. If the obligation to wear a reflective vest has been passed, the guilt or co-payment for the accident may be charged to a pedestrian who will ignore the order and be struck. However, if the deduction comes to the side of the illuminated road, the lack of flares will not matter to the police. The insurer to reduce the value of the compensation paid to the deducted pedestrian, however, can use this circumstance.

Road safety: mandatory yellow vests for bikers

In recent days, a new accessory is featured prominently in the product line for two-wheelers: the safety vest. Mandatory for motorists since 2008, it is now essential for drivers of mopeds, motorcycles and scooters. “This is a classic vest as motorists have in their vehicle for a few years now,” says Stephen Brooches, manager of a store in Limoges in Haute-Vienne.

Police traffic engineers surveyed 607 places where fatal accidents last year. In 42 cases, they proposed measures to prevent or at least mitigate the consequences of accidents. Police officers will continue this year’s inspections, also focusing on places where the drivers themselves warn them.

 

“We are trying to make these places safer if we find that their condition could have an impact on the accident or its consequences,” said Tomas, head of traffic police. Traffic police officers suggest wearing a reflective vest to keep safety, for example, renewing or changing the markings to guide the driver, for example, when crossing the junction.

“It’s about making the security elements so-called forgiving. That is, when the driver makes a mistake to prevent serious consequences, such as getting out of the road and hitting a tight hurdle, “Letch said.

 

Police officers also deal with drivers’ suggestions when typing dangerous sites. So far, unfortunately, there is no uniform system where drivers can report their traffic signs. That may change. “We are talking about a systemic measure with the BESIP department that would create a uniform application,” said the head of the traffic police. Already now, police say they deal with every stimulus they get.

 

In 2015, traffic engineers detected 11,288 faults on road signs. They also checked about 1,500 rail crossings where they found 755 things that could improve. “Of course, we check whether these defects are removed,” Letch assured. Most of the reported bugs the communications manager managed to remove.

Increased security on major sections of motorways, expressways and some first-class roads is also to be assisted by ongoing police surveillance. “We want to establish communications where regular police surveillance will be the rule,” said deputy police president Martin. In addition, there are also no hidden patrols, including fifty new civilian cars equipped with measuring technology.

 

In addition to improving traffic signs and repression, traffic police will arrive this year with several preventive actions. For example, pedestrians will give out reflective tapes that will increase their visibility in poor lighting conditions, drivers and bikers present at major events will offer again.

Last year, police executed 1,664 preventative-security control actions. They found nearly 3,000 cases when the driver ate alcohol, and 854 people were driving under the influence of narcotics. During the inspections, 24 stolen vehicles were found; in almost 580 cases, a man without a valid driver was sitting behind the wheel.

The Senate unanimously approved an amendment that, among other things, will allow municipalities to restrict the operation. Norm also orders pedestrians to wear reflective elements outside the village if darkness or otherwise impaired visibility.

 

The law also allows the police to withhold a small technical license in the event of a poor technical condition of the vehicle. The Senate has decided against it today despite the efforts of some senators who wanted, among other things, to take police officers the right to measure the speed of driving or to allow cyclists to ride after drinking less alcohol.

 

The novel, which also obliges motorists to clean vehicles from ice and also from snow, if they prevent them from viewing, will be signed by the president.

“The ministry of transport has a negative opinion on the proposal to drop the possibility of measuring the speed of municipal traffic by the police,” the minister of transport, Dan, told the senators. He justified this inter alia by not discussing this change with the authorities concerned and assessing its impact on both traffic safety and radar investment.

 

He wanted to remove the right to measure the speed of the chairmen of ODS senators and the Mayor of Teplice. He argued that many municipalities want only to improve their income and speed to measure outside the built-up area. He also pointed to the administration and the increase in unpaid fines, which he said last year climbed to 43 million crowns.

 

What does the law introduce?

– Municipalities can regulate the operation

– Pedestrians can move between the villages in the dark or otherwise reduced visibility only with reflective vest, otherwise they are liable to a fine of up to 2000 crowns

– The police can withhold a small technical card if the vehicle is in poor condition

– Motorists are obliged to clean the vehicles from ice and snow if they prevent them from viewing

– For six months, the authorities may withdraw a driver who drives a railway crossing at a time when signaling works

 

Senate Vice-President proposed to allow cyclists, either according to the Austrian model, 0.8 per mile of alcohol in the blood if they were traveling on third-class roads and / or cycle paths, or alternatively 0.5 per mile. He also wanted to limit the maximum penalty for alcohol for cyclists to 500 crowns.

 

To the duty of reflective elements for pedestrians, vests or only strips on the sleeve, the Minister of Transport stated that the violation would amount to a fine of two thousand dollars. Wok also said the ministry had a deal with the police to give people more of their reflective tapes.

He also announced that his office is seeking an agreement with the Czech Association of Insurers to ensure the removal of non-mobile vehicles. He responded to the request of Senator (for the SZ) that the government should take action against overtaking offshoots.

We also want to show how clothing with reflective elements can not only work but also looks good. That is why we have prepared a proposal for a collection of sportswear for women, and we will introduce other ways of using reflective materials, especially for children, “says Martin, head of BESIP, to add to the unique festival:

We contacted the Technical University of Liberec, where they patented the unique use of nanotechnology to illuminate various items, including clothing. BESIP, in cooperation with Active Czech Republic’s Mobility Unit, has prepared an exhibition in Prague, based on reflexive elements, from their use to clothing to more and more popular reflexive tapes, an attractive part of the exhibition and a look into the future. We will see the unique models of dresses of Slovak designer Susana who used lighting elements for women’s dresses and accessories, but also the use of this technology in the near future: from warning vests through rescue workers’ clothing to accessories for athletes.

 

BESIP security patrols will also be part of the festival and will help to ensure the safety of people traveling along the festival’s path in bright shining clothing. “By working with the university and the company that is in charge of commercial patent use, we are among the first to get the final prototype vests that not only meet all the parameters in terms of the use of reflexive materials but also feature luminous elements. This adds a new dimension to pedestrian visibility, “adds Martin.

 

“However, it is important to STRESS that such an outfit requires an active source, and for the visibility of pedestrians there is something extra. By law, the pedestrian outside the village must be equipped with reflective elements and any light, even self-evident and visible, is not sufficient. It must always be used in combination with reflexive material, just in cases when light comes out of energy, “he says.

 

Let us add that, as of 20 February this year, an amendment to the law, which clearly sets out pedestrians outside the municipality, obliges them to wear reflective vest that are visible to all other road users, front, back and side. In this sophisticated period, it should be remembered that the reduced visibility is not only the time from sunset to its east, but also fog, heavy rain or snowfall, so reflective elements are mandatory under these conditions even at the time of day.
